These Terms and Conditions (“Terms”) govern your use of the website thespinesurgerycenter.com (the “Site”) and your participation in the text messaging program operated by The Spine Center (The Spine Center LLC, “we,” “us,” or “our”). By using the Site or opting in to our text messaging program, you agree to these Terms. If you do not agree, please do not use the Site or the messaging program.
1. Use of the Site
The Site and its content are provided for general informational purposes only. Nothing on the Site is medical advice, and use of the Site does not create a physician-patient relationship. Always seek the advice of a qualified physician regarding any medical condition. If you are experiencing a medical emergency, call 911.
You agree to use the Site only for lawful purposes and not to interfere with its operation or security, attempt unauthorized access, or use the Site in any way that violates applicable law.
2. SMS/Text Messaging Program
The Spine Center Text Program
- When you opt in, you can expect to receive text messages from The Spine Center related to your care, including appointment confirmations and reminders, scheduling and rescheduling notices, links to intake and registration paperwork, pre-visit and post-visit instructions, office logistics such as location and arrival information, and replies to questions you text us.
- You can cancel the SMS service at any time. Just text “STOP” to the number that messaged you. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, text START to our business number and we will start sending SMS messages to you again.
- If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at info@thespinesurgerycenter.com or 833-774-6311. Carriers are not liable for delayed or undelivered messages.
- As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Consent. Consent to receive text messages is not a condition of purchase or of receiving treatment. You opt in to the text messaging program by texting the keyword START to one of our business numbers, following the instructions provided on our website. By texting START, you consent to receive informational text messages from The Spine Center about appointment reminders, scheduling updates, and care instructions at the mobile number you texted from. We do not send promotional or marketing messages, and we do not buy, rent, or import mobile numbers from third parties.
Privacy of opt-in data. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.
Your responsibilities. You represent that you are the owner or authorized user of the mobile number you provide. If you change or deactivate your mobile number, please notify us promptly so we can update our records. Do not send protected health information you consider sensitive over SMS; standard text messages are not encrypted.
3. Intellectual Property
All content on the Site, including text, graphics, logos, images, and software, is the property of The Spine Center or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission.

The Site may contain links to third-party websites. We do not control and are not responsible for the content or privacy practices of those sites. Linking does not imply endorsement.
5. Disclaimer of Warranties
The Site and the messaging program are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or messaging program will be uninterrupted, timely, secure, or error-free, or that messages will be delivered without delay.
6. Limitation of Liability
To the fullest extent permitted by law, The Spine Center will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or the messaging program, including delayed or undelivered messages. Carriers are not liable for delayed or undelivered messages.
7. Indemnification
You agree to indemnify and hold harmless The Spine Center and its officers, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Site or messaging program.
8. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any dispute arising under these Terms will be brought exclusively in the state or federal courts located in Texas, and you consent to the jurisdiction of those courts.
9. Changes to These Terms
We may update these Terms at any time. The revised version will be posted on this page with a new “Last updated” date. Your continued use of the Site or the text messaging program after a change means you accept the updated Terms.
